Are Court Records Public in Lea County?

Individuals can also obtain Lea County criminal records by mail at the NM Department of Public Safety (DPS) Law Enforcement Records Bureau (LERB). The LERB will only release the desired record after receiving a complete notarized Authorization for Release of Information form and a fee of $15 payable by money order or cashier's check. Get Lea County Civil Court Records

The Lea County District Court hears all civil matters like condemnation, property damage, adoption, probate, personal injury, foreclosure, debt, appeals from lower courts (municipal court, magistrate court), water adjudications, and mental illness. Lea County Birth and Death Records

Lea County vital records are restricted but tend to become public after a while. For example, Lea County birth certificates become public 100 years after birth, while death certificates are confidential until 50 years after death. Confidential birth and death records are only available to the registrant, the decedent's immediate family members, or those with a legal interest in the record. The immediate family could be a sibling, parent, current spouse, grandchild, maternal or paternal grandparent, or child.

Birth and death records can be obtained online, by phone, by mail, or in person at the New Mexico Bureau of Vital Records and Health Statistics. The Bureau partners with a third-party vendor to issue birth and death records online and over the phone at (877) 284-0963 to requesters. Orders take 3 to 5 business days to process. Depending on the delivery methods, the vendor charges between $44.5 and $26 for Lea County birth records and $39.50 to $21 for death records. Payments can be made via major credit cards like Discover, American Express, MasterCard, or Visa.

Order birth or death records via mail by completing a Birth or Death Record Search Application form or submitting a written letter. The mail package must include a photocopy of a government-issued photo ID and the necessary fees. Certified copies of death records cost $5 per certified copy, while birth records cost 10 per certified copy. Payments should be made by certified check or money order. The written letter should contain the following information:

  • The birth registrant or descendant's name
  • The birth or death date
  • The city and county of birth or death
  • The mother's full maiden name and father's full name (for those requesting birth records)
  • The decedent's Social Security Number, if known.
  • The name of the mortuary in charge of final arrangements.
